Definitions
The data protection declaration is based on the terms of the Datenschutzgrundverordnung / Data Protection Regulation (DSGVO).
“Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”) (Art. 4 No. 1 DSGVO). Your personal data includes information such as your master data (first and last name, address, and date of birth), your contact data (telephone number, e-mail address), your billing data (bank details) and much more.
“Processing” means any operation or set of operations which is performed upon personal data, whether by automatic means, such as collection, recording, organization, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
“Data subject” means any identified or identifiable natural person whose personal data are processed by the controller.
“Controller” means the natural or legal person, public authority, agency, or other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for under Union or Member State law.
“Processor” means a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller.
“recipient” means a natural or legal person, public authority, agency, or other body to whom personal data are disclosed, whether a third party. However, public authorities that may receive personal data in the context of a specific investigative task under Union or Member State law shall not be considered as recipients.
“Third party” means any natural or legal person, public authority, agency, or body other than the data subject, the controller, the processor, and the persons authorized to process the personal data under the direct responsibility of the controller or the processor.
“Consent” means any freely given specific and informed indication of the data subject’s wishes, in the form of a statement or other unambiguous affirmative act, by which the data subject signifies his or her agreement to the processing of personal data relating to him or her.
Collection and processing of personal data
The use of our website is possible without any indication of personal data. However, if you want to use special services of our enterprise via our website, processing of personal data could become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.
Anonymous data collection
You can visit our site without actively providing any personal information. However, we automatically save access data (server log files) each time you call up the website, such as the name of your Internet service provider, the operating system used, the website from which you are visiting us, the date and duration of the visit or the name of the file requested, as well as the IP address of the computer used for a period of 7 days for security reasons, e.g. to detect attacks on our websites. This data is evaluated exclusively to improve our services and does not allow any conclusions to be drawn about your person. This data is not merged with other data sources. The legal basis for the processing of the data is Art. 6 para. 1 DSGVO. We process and use the data for the following purposes: 1. Provision of the ABC Umformtechnik GmbH & Co. KG. websites, 2. Improving our websites and 3. Preventing and detecting errors/malfunctions and misuse of the websites. Data processing of this kind is either carried out to fulfil the contract on the use of the ABC Umformtechnik GmbH & Co. KG websites or we pursue a legitimate interest in ensuring the functionality and error-free operation of the ABC Umformtechnik GmbH & Co. KG websites and to adapt these websites to the requirements of the users.

The user is advised that e-mails can be read or changed unauthorized and unnoticed on the transmission path. ABC Umformtechnik GmbH & Co. KG uses software to filter unwanted e-mails (spam filter). The spam filter can reject e-mails if they have been falsely identified as spam by certain characteristics.
The data you enter will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g., after we have completed processing your enquiry). Mandatory legal provisions – in particular, retention periods – remain unaffected.
Contact form/inquiries
On our website, you have the option of sending us enquiries using the contact form. The information you provide in the contact form (content of your enquiry, subject of your enquiry and date, area) including the contact data you provide there (name, surname, address, country, and email) will be stored by us for the purpose of processing the enquiry and in the event of follow-up enquiries. We do not pass on this data without your consent. The legal basis for the collection and processing of the data is Art. 6 para. 1 DSGVO.

Transmission internally, within ABC Umformtechnik GmbH & Co. KG
We transfer your data internally to the administration, personnel department, and payroll department to fulfil our contractual or legal obligations. Your data will only be transferred or disclosed to the extent necessary for this purpose and in compliance with the relevant data protection regulations.
Group-wide transmission
ABC Umformtechnik GmbH & Co. KG is a globally active company based in Germany. The data you transmit to us is stored in our centralized customer database in Germany and passed on within the group for administrative purposes. If data is exchanged within the group, this is done to fulfil a contract or as a condition of use for the websites. In addition, there may be an interest in passing on this data for internal, administrative purposes. If the processing of your data takes place outside Europe, for example in India, Brazil, Russia, China, Switzerland, Singapore or the USA, this transfer will take place in compliance with all applicable data protection laws and in particular in accordance with Art. 44 f. DSGVO.
Transfer to third parties
We transfer your data to certain third parties to be able to provide corresponding applications and services (so-called “order processors”), who provide external services for us. For example, newsletter services, IT providers, tax offices, etc. A transfer to other third parties may take place to fulfil our obligations (authorities, banks, social security institutions, etc.). Third parties process the data only in accordance with our instructions and are prohibited from using this data for their own commercial purposes that do not correspond to the agreed purposes.
We must disclose personal data if we are obliged to do so as part of ongoing legal proceedings, based on an injunction, by law or under applicable law (Art. 6 para. 1 lit. f DSGVO).
We only disclose your personal data to third parties if:
you have given your express consent to do so in accordance with Art. 6 Para. 1 S.1 lit. a DSGVO,
the disclosure is necessary for the assertion, exercise, or defense of legal claims in accordance with Art. 6 para. 1 sentence 1 lit. f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
if there is a legal obligation for disclosure in accordance with Art. 6 Para. 1 Sentence 1 lit. c DSGVO, as well as
this is legally permissible and necessary for the processing of contractual relationships with you according to Art. 6 para. 1 p. 1 lit. b DSGVO.
If the processing of your data takes place outside Europe, for example in India, Brazil, Russia, China, Switzerland, Singapore or the USA, this transfer will take place in compliance with all applicable data protection laws and in particular in accordance with Art. 44 f. DSGVO.
Transmission to a third country or international organization
There is no transfer to a third country or an international organization.
Existence of automated decision-making including profiling
As a responsible company, we do not use automated decision-making or profiling.
Duration of storage
We generally store your data for as long as is necessary for the provision of our online offer and the associated services or if this has been provided for by the European Directive and Regulation Maker or another legislator in laws or regulations to which the controller is subject. In all other cases, we delete your personal data after the purpose has been fulfilled, except for data that we must continue to store to comply with legal obligations (e.g., we are obliged to retain documents such as contracts and invoices for a certain period of time due to retention periods under tax and commercial law).
Technical security
ABC Umformtechnik GmbH & Co. KG uses technical and organizational security measures to protect the data we have under our control against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons. Our security measures are continuously improved in line with technological developments.
We would like to point out that data transmission on the Internet (e.g., communication by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.
Legal basis of processing
Article 6 I lit. a DSGVO serves as the legal basis for our company for processing operations in which we obtain consent for a specific processing purpose.
If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art. 6 I lit. b DSGVO. The same applies to processing operations that are necessary for the implementation of pre-contractual measures, for example in the case of enquiries about our products or services.
If our company is subject to a legal obligation by which the processing of personal data becomes necessary, such as for the fulfilment of tax obligations, the processing is based on Art. 6 I lit. c DSGVO.
In rare cases, the processing of personal data might become necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were to be injured on our premises and as a result his or her name, age, health insurance details or other vital information had to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 I lit. d DSGVO.
Finally, processing operations could be based on Art. 6 I lit. f DSGVO. Processing operations that are not covered by any of the legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights, and freedoms of the data subject are not overridden. If the processing of personal data is based on Article 6 I lit. f DSGVO, our legitimate interest is the performance of our business activities for the benefit of the well-being of all our employees and our customers.
Legal or contractual regulations for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of not providing the data.
We would like to inform you that the provision of personal data is sometimes required by law (e.g., tax regulations) or may also result from contractual regulations (e.g., information on the contractual partner). Sometimes, to conclude a contract, it may be necessary for a data subject to provide us with personal data that must subsequently be processed by us. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with him or her. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before providing personal data by the data subject, the data subject must contact one of our employees. Our employee will explain to the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences of not providing the personal data would be.
Notice for minors
This online offer is not directed at children under the age of 16. Persons who have not yet reached the age of 16 may not transmit any personal data to ABC Umformtechnik GmbH & Co. KG without the consent of a parent or guardian.
Rights of the data subjects
You have the right:
in accordance with Art. 15 DSGVO, to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected from us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
in accordance with Art. 16 DSGVO, to demand the immediate correction of inaccurate or incomplete personal data stored by us;
in accordance with Article 17 DSGVO, to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims;
in accordance with Art. 18 DSGVO, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 DSGVO;
in accordance with Art. 20 DSGVO, to receive your personal data that you have provided to us in a structured, common, and machine-readable format or to request that it be transferred to another controller (data portability);
insofar as your personal data are processed based on legitimate interests pursuant to Art. 6 para. 1 S.1 lit. f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, insofar as there are grounds for doing so that arise from your situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation;
complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace for this purpose.
Revocation of your consent to data processing
Some data processing operations are only possible with your express consent. You have the possibility to revoke an already given consent at any time. All you need to do is send us an informal e-mail to datenschutz@www.abc-umformtechnik.com. The legality of the data processing carried out until the revocation remains unaffected by the revocation.
